UberLotto – Terms and Conditions / Terms of Service

THESE TERMS INCLUDE A BINDING ARBITRATION CLAUSE AND A CLASS ACTION WAIVER IN SECTION 12. THEY LIMIT YOUR LEGAL RIGHTS AND REMEDIES. PLEASE READ THEM CAREFULLY.

 

These Terms and Conditions ("Terms") form a binding agreement between you ("you", "your", or "user") and UberLotto Ltd. and its subsidiaries and affiliates ("UberLotto", "we", "us", or "our"). These Terms govern your access to and use of our website www.playuberlotto.com, mobile applications, and related platforms (collectively, the “Website”), along with any associated products or services we provide (collectively, the “Services”).

 

UberLotto is a third-party lottery concierge platform. We are not affiliated with or endorsed by any official government lottery or lottery operator. By using our Services, you confirm that you have read, understood, and agree to these Terms, our Privacy Policy, and any other terms and policies we publish (collectively, “Policies”). If you do not agree to these Terms or our Policies, you must not use the Services.

 

We reserve the right to update or modify these Terms at any time, in our sole discretion. Your continued use of the Services constitutes acceptance of the revised Terms.

 

I. TERMS OF USE

1. General Description

UberLotto provides an international lottery concierge and ticket pooling service that enables eligible users to:

  • Participate in pooled lottery ticket purchases,

  • Receive scanned digital images of tickets purchased on their behalf,

  • Get notified of winnings and payout options,

  • Access results and pool details via the Website or mobile app.

Tickets are purchased from licensed, local retailers by UberLotto or its authorized agents. You are not entitled to physical delivery of a ticket unless required by applicable law or agreed upon in writing.

 

We may charge service and convenience fees for ticket purchasing, scanning, storage, digital access, and secure claim management.

 

2. Eligibility

To create an account and use our Services, you must:

  • Must be at least 18 years of age (or the age of majority in your jurisdiction),

  • Not be a citizen, resident, or current location user of the United States or any OFAC-sanctioned country,

  • Not appear on INTERPOL Red Notices or other sanctions/watchlists,

  • Use only legally obtained, taxed funds,

  • Not use the Services for money laundering, terrorist financing, or any illegal activity,

  • Pass identity verification (KYC) and AML screening through our partner (e.g., Sumsub),

  • Agree to these Terms and our Privacy Policy.

Prohibited Persons may include, but are not limited to:

  • Individuals or entities on government blacklists or sanctions lists,

  • Individuals using VPNs or proxy services to mask location,

  • Individuals involved in fraudulent or high-risk activity,

  • Users previously banned from the platform for violating our terms.

We reserve the right to refuse service, suspend accounts, or withhold winnings at our sole discretion if we believe you violate eligibility terms.

 

3. Account Registration

You may only register one (1) personal UberLotto account. During registration, you must provide accurate information, including:

  • Full name

  • Date of birth

  • Residential address

  • Country of citizenship

  • Valid government-issued ID

  • Email and phone number

  • Wallet/payment information

You authorize UberLotto to verify your identity and conduct compliance checks through third-party providers.

 

You are responsible for keeping your login credentials secure and confidential. You agree not to share your account with others or use someone else’s account. If you believe your account has been compromised, notify us immediately at support@playuberlotto.com.

 

We are not responsible for losses resulting from unauthorized account access unless due to our own gross negligence or misconduct.

 

4. Jurisdiction and Location Verification

You must be physically located in a jurisdiction where UberLotto is legally permitted to operate to use our Services. Use of the platform is strictly prohibited from:

  • The United States,

  • OFAC-sanctioned countries,

  • Jurisdictions with explicit bans on third-party lottery services.

We may use location detection technologies (such as IP analysis, WiFi, device geolocation, and third-party verification) to confirm your physical location before allowing access or processing orders. By using the platform, you consent to this verification.

 

If your location cannot be verified or is found to be in a restricted area, access may be blocked or suspended without notice.

 

5. Payments, Deposits, and Withdrawals

UberLotto supports multiple funding methods, including but not limited to:

  • Cryptocurrency (e.g., BTC, ETH, USDT, USDC)

  • Bank wire transfers

  • PayPal

  • Prepaid credits or account top-ups

All deposits into your UberLotto account are non-refundable unless required by law. You agree to pay any applicable service or convenience fees.

 

When requesting a withdrawal, you may be required to:

  • Verify your identity again

  • Submit proof of wallet ownership

  • Comply with applicable KYC/AML documentation

Withdrawals will generally be sent back via the same method used for deposit, unless that method is not available. We are not responsible for delays or errors caused by third-party processors.

 

You are solely responsible for reporting and paying any taxes on winnings or transactions in your home country. UberLotto does not provide tax advice.

 

6. Chargebacks and Unauthorized Payments

You agree not to reverse or dispute any authorized transactions (“chargebacks”).

 

If you initiate a false chargeback or commit financial fraud, UberLotto may:

  • Suspend or permanently close your account

  • Withhold funds and winnings

  • Report your account to the relevant authorities

  • Recover financial losses from you, including legal and processing costs

We reserve the right to work with payment processors and fraud prevention platforms to investigate disputed charges.

 

7. Ticket Orders, Pooling, and Winnings

A. Ticket Orders and Cutoff Times

Orders placed through UberLotto represent a request for ticket purchasing and pooling services. Orders are not final until confirmed. Cutoff times for ticket purchases vary by game and region. Orders placed after the cutoff may be rolled over into the next available drawing. If a ticket order cannot be fulfilled for any reason (e.g., pool full, game closed, technical error), your payment will be applied to the future game.

 

B. Ticket Ownership and Scans

Tickets are purchased by UberLotto or its agents and securely stored. You will receive a digital scan of each ticket linked to your account. UberLotto retains physical custody of the ticket.

 

C. Winnings Distribution

For small or pooled winnings, UberLotto will verify results and credit your account. You may then:

  • Withdraw the winnings, or

  • Use them to play again.

For large wins (typically over the jurisdictional reporting threshold or involving jackpots), UberLotto will:

  • Notify you directly

  • Begin the identity verification process

  • Arrange for tax compliance and prize claim

  • Transfer physical custody of the ticket (if required)

We are not liable for lost or unclaimed winnings due to your failure to verify identity or comply with required documentation, or respond to UberLotto.

 

8. Account Suspension and Termination

We reserve the right to suspend or permanently close your account, with or without notice, if:

  • You violate these Terms or any applicable law

  • You attempt to use the service from a restricted jurisdiction

  • We suspect fraud, money laundering, or misuse of payment methods

  • You fail to complete KYC/AML verification

  • We receive a lawful request from a regulatory authority

If your account is closed for any of the above reasons, we may:

  • Void or freeze ticket orders and winnings

  • Withhold remaining balances pending investigation

  • Report suspected misconduct to relevant legal or financial authorities

UberLotto is not liable for losses arising from account suspension or closure in these circumstances.

 

9. Limited Power of Attorney

By using UberLotto, you authorize us and our agents to act on your behalf solely for the purpose of:

  • Purchasing official lottery tickets from authorized retailers

  • Scanning and storing those tickets

  • Claiming prizes on your behalf and/or for pool and pool members

  • Managing pooled ticket winnings

  • Arranging delivery of a physical ticket (in the event of a large win, if legally required).

This limited power of attorney is non-transferable and applies only to the scope of our lottery concierge services.

 

10. Intellectual Property

All content on the Website and app—including but not limited to text, graphics, logos, software, code, and images—is the intellectual property of UberLotto or its licensors and is protected by applicable copyright, trademark, and intellectual property laws. You may not copy, reverse-engineer, distribute, sublicense, or modify any portion of the platform or its content without our prior written consent.

 

11. Limited License

We grant you a non-exclusive, non-transferable, revocable license to access and use our Website and Services for personal, lawful, and non-commercial purposes only.

 

You agree not to:

  • Use bots or automated tools to access the platform

  • Interfere with security features or system integrity

  • Exploit or misuse any part of the Services

Violation of this license may result in termination of your access.

 

12. Arbitration and Class Action Waiver

A. Binding Arbitration

If a dispute arises between you and UberLotto, you agree to first attempt to resolve it informally by contacting support@playuberlotto.com. If we cannot resolve the dispute within 45 days, both parties agree to submit the matter to binding individual arbitration in a jurisdiction (to be selected based on UberLotto location or ticket jurisdiction).

 

Arbitration will be administered by an independent third party, and both sides waive the right to a public trial or jury.

 

B. Waiver of Class Actions

To the extent permitted by law, both parties agree that:

  • Disputes will be resolved only on an individual basis

  • No party may bring a class, consolidated, or representative action

You understand and agree that you are waiving your right to participate in a class action or group arbitration proceeding.

 

13. Governing Law and Jurisdiction

These Terms are governed by the laws of the jurisdiction in which UberLotto is incorporated, without regard to conflict of law principles. For users located outside our incorporation jurisdiction, your local consumer protection laws may still apply as required by mandatory international law. If arbitration is deemed unenforceable, or for equitable relief (e.g., intellectual property disputes), both parties agree to submit to the exclusive jurisdiction of the courts located in the governing legal territory of UberLotto. You waive any objections related to venue or jurisdiction to the extent permitted by law.

 

14. Limitation of Liability

To the fullest extent permitted by applicable law:

  • UberLotto and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, even if we were advised of the possibility of such damages.

  • Our total liability to you for all claims related to the Services shall not exceed the total amount you deposited or spent on UberLotto in the past 12 months.

  • We are not liable for:

    • Errors by third-party payment or identity verification providers

    • Service interruptions due to internet, blockchain networks, or force majeure events

    • Failure to claim winnings due to incomplete user verification

This limitation does not exclude liability that cannot be disclaimed under applicable law (e.g., death or personal injury caused by our gross negligence or fraud).

 

15. Warranties Disclaimer

Our Services are provided “as is” and “as available.”

UberLotto makes no representations or warranties, express or implied, including but not limited to:

  • Warranties of merchantability or fitness for a particular purpose

  • That the Website or Services will be uninterrupted, secure, or error-free

  • That any specific winnings will be achieved by using UberLotto

You assume full responsibility for your use of the Services.

 

16. Indemnification

You agree to defend, indemnify, and hold harmless UberLotto, its officers, employees, agents, and affiliates from and against any claims, losses, damages, liabilities, and expenses (including legal fees) arising from:

  • Your breach of these Terms

  • Your violation of applicable laws or regulations

  • Your misuse of the Website or Services

  • Your use of UberLotto from a prohibited jurisdiction

  • Any claim involving your user content or third-party rights

We reserve the right to assume the exclusive defense of any matter for which you are required to indemnify us.

 

17. Privacy Policy

Your use of the Services is also governed by our Privacy Policy, which is incorporated into these Terms by reference. You agree that any dispute concerning your data, privacy rights, or data processing shall be resolved under the limitations and dispute resolution procedures in these Terms.

 

18. Force Majeure

UberLotto shall not be held liable for any delay or failure to perform due to causes beyond our reasonable control, including but not limited to:

  • Natural disasters (e.g., earthquakes, floods, pandemics)

  • Civil unrest or war

  • Technical failures, including blockchain outages or server downtime

  • Government action or legal restrictions

  • Utility failures or supply chain disruptions

In such events, obligations may be suspended for the duration of the disruption.

 

19. Amendments and Updates

We may modify or update these Terms at any time. When changes are made, we will:

  • Post the revised Terms on the Website

  • Update the “Last Modified” date

  • Notify users where required by law

Your continued use of the Services after changes are posted constitutes acceptance of the new Terms. If you disagree, you must stop using the Services and close your account.

 

20. Assignment

We may assign or transfer our rights and obligations under these Terms without restriction. You may not assign or transfer your rights without our prior written consent.

Any attempt to do so without our consent will be null and void.

 

21. Severability

If any provision of these Terms is found invalid, illegal, or unenforceable, the remaining provisions will remain in full force and effect.

 

22. Compliance with Local Laws

You are solely responsible for ensuring your use of UberLotto complies with local laws, regulations, and restrictions. Use of UberLotto is prohibited in jurisdictions where online lottery concierge services are illegal.

 

23. Responsible Gaming and Self-Exclusion

UberLotto encourages responsible play. You may:

  • Set deposit or spending limits in your account

  • Request self-exclusion for a defined time period

  • Request permanent account closure

To initiate any of these actions, contact support@playuberlotto.com.

We do not knowingly accept users under the age of 18. If we discover such use, the account will be immediately terminated.

 

24. Scam and Fraud Warnings

UberLotto will never ask you to pay fees to claim a prize, nor contact you unexpectedly requesting sensitive information.

 

Signs of lottery scams may include:

  • Unsolicited emails or messages claiming you’ve won

  • Requests for bank details or crypto wallets for prize delivery

  • Urgent calls to action or threats of account suspension

If you suspect a scam using UberLotto’s name, report it to fraud@playuberlotto.com.
